Carson City Sheriff's arrest log: Man booked on felony child abuse, strangulation

A Carson City man was taken into custody at 5 p.m. Friday at the Carson City Sheriff's Office for multiple felony offenses, a Sheriff's deputy said, including child abuse and domestic battery with strangulation.

Jose Luis Diaz was arrested following a domestic battery report by the victim the night before. According to the arrest report, the minor victim said Diaz had demanded he hand over his cell phone. When the victim refused, the suspect assailed him by pulling on his shirt and placing him in a choke hold.

The victim had reported Diaz shouted at him, "I can break your neck little boy!" while keeping him locked in the choke hold. The victim reported to a Sheriff's deputy that he experienced pain and difficulty breathing while in the choke hold.

Then Diaz threw the victim to the ground, according to the victim's report to the deputy, and screaming repeatedly at the victim, "You think you are a man now, huh? I will fuck you up!"

During the interview with the deputy, the victim revealed a large red bruise on his right shoulder. He also winced while moving his neck and arms. Bruising was observed on the victim's right rib cage as well, the report said.

The deputy contacted the Nevada Division of Child and Family Services to respond with assist on the case. The victim's mother was contacted by telephone and later interviewed at the sheriff's office, the report said.

She initially confirmed that Diaz had the victim in a choke hold, but then changed her story, stating the two here hugging and there was never any struggle or fight. She described the victim as the aggressor, and that Diaz had to place him in a restraint because he was being incorrigible toward her concerning the cell phone.

Diaz was interviewed later Friday afternoon at the sheriff's office, the report said, and he agreed to speak with the deputy after a Miranda Warning had been read to him.

Diaz reported that the victim's mother initially demanded he turn over his phone, and the victim responded by balling his fists toward her. At that point, the suspect reported that he gave the victim a bear hug and gently leaned him toward the ground.

According to the deputy's report, Diaz went off on racist tirades about white people and white cops during the interview.

Diaz had initially stated the victim tells the truth, according to the report, but then quickly recanted and stated the victim had become a liar ever since getting together with his girlfriend.

Diaz later was found standing up and facing the wall of the interview room with his feet spread apart and his hands up in the air. He told the deputy he knew he was going to be arrested and did not want to give police the opportunity to shoot and kill him.

Diaz was handcuffed and arrested at that point. Once in custody, though, the suspect went off on more rants on racism, getting highly agitated and calling the arresting deputies names, the report said. Bail: $40,000.

In other arrests:

— A 46 year-old man was arrested early Saturday morning at 3 a.m. for misdemeanor destruction of property and for an outstanding petit larceny warrant, a Carson City Sheriff's deputy said.

According to the report, law enforcement was dispatched on a complaint of property destruction. Upon arrival at the scene in the 500 block of North Carson Street, a Sheriff's deputy made contact with the victim, who reported that he witnessed a man bend the rear windshield wiper arm on his vehicle.

The suspect also reportedly dented an area above the vehicle's passenger door in an attempt to open the door for the gas tank, the report said.

Both the victim and the suspect were present at the scene when law enforcement arrived. The victim sought to press charges, signing a citizen's arrest form and witness statement.

A records check on the suspect confirmed an active bench warrant against him out of Fallon Municipal Court on petit larceny charges.

The suspect was handcuffed at that point and transported to the Carson City Jail for booking. Bail: $630.

— A Walnut, CA, woman was taken into custody Friday afternoon at 2:30 p.m. on a confirmed felony bench warrant issued out of the Carson City Justice Court, a Carson City Sheriff's deputy said.

Francesca Bertolini was booked into the Carson City Jail for an outstanding arrest warrant on the category D felony offense of fraudulent use of a credit/debit card, the report said. Bail: $5,000.

— A Las Vegas man was arrested Friday afternoon at 2 p.m. at the Carson City Jail upon being transported by Douglas County authorities, a Carson City Sheriff's deputy said.

According to the report, a Douglas County Sheriff's deputy transported the man to Carson City on multiple outstanding misdemeanor arrest warrants.

One active bench warrant was issued out of the Carson City Justice Court on a criminal contempt charge. Another was issued out of Reno Township for failing to pay or appear on charges of hunting/trapping/fishing without a license or permit. And a third outstanding warrant was issued from Sparks Justice Court on charges of failure to appear in traffic court.

The man was booked into the Carson City Jail without incident. Bail: $615.

Cracking a window often does nothing at all as rolling down the windows has been shown to have little effect on the temperature inside a car, according to the Humane Society of the U.S.

Today I started pruning out the water sprouts in my four crabapple trees. Some people might call these “suckers,” but suckers grow up from the bottom of the trunk and water sprouts grow in the upper parts of the tree. Carson City Fire Department and sheriff's deputies were called Saturday night to a brush fire in the area of Lepire Drive in East Carson City.
